Similar to the H-1B visa, the H-1B3 visa requirements include that the worker with highly specialized knowledge or skills must be hired by a United States employer to be eligible for an H-1B3 Specialty Worker visa. 

H-1B3 Visa Requirements

The H-1B3 visa is good for up to six years. The United States employer must meet wage requirements which are designed to prohibit United States companies from hiring immigrants for the purpose of minimizing company costs and lowering wages in any given field of work. 

The specific requirements for the H-1B3 visa are as follows:

  • Applicant must work as a fashion model
  • Applicant must be nationally or internationally recognized for achievements in modeling
  • Applicant must be employed in a position which requires a model who has distinguished ability

H-1B3 Visa Fees and Costs

The H-1B3 visa costs include a $320 filing fee for the Petition for Nonimmigrant Worker which is paid by your employer.  Your costs will include the visa application fee of $131.00.

H-1B3 Visa Documents Needed

The employer will have to submit the following H-1B3 documents:

  • An approved Labor Certification
  • Form ETA 9035 with the petition for Nonimmigrant Worker Form I-129
  • Evidence that applicant is nationally or internationally recognized for achievements in modeling
  • Evidence of National or International recognition in the form of major newspaper, trade journals, magazines or other publications
  • Evidence that you have received recognition for significant achievements from organizations, critics, or other recognized experts in the field
  • Evidence that you have commanded a high salary as shown by contracts or other reliable sources
  • Evidence from your employer that establishes that the modeling services you will perform require a fashion model of distinguished merit and ability and either:
  • Your modeling services are for an organization or establishment that has a distinguished reputation or record of employing models of distinguished merit and ability
