The right of a parent to apply for citizenship for his or her child is based on the Immigration & Nationality Act 2000. Citizenship can be applied for on behalf of a child if they or the other parent has American citizenship. This is true even if the child was born in another country. As laid out under the Child Citizenship Act of 2001, a child that was born or adopted to US citizens would now acquire citizenship.

The Child Citizenship Act 2001

Under the Child Citizenship Act, before applying for US citizenship for a child, certain criteria must be met. The first guideline for citizenship of children states at least one parent must be an American citizen and be living with that parent. The child will also need to be admitted to the United States as a permanent resident to fulfill the citizenship criteria. It was also be important that the criteria to obtain citizenship are fulfilled will the child is not already 18 years of age. Citizenship can also be applied for adopted children, but the child citizenship act requires that the adoption be completely finalized be fore citizenship is granted.

Documents Needed For Application

To apply for citizenship for your child, there are a few documents that are needed. The first is the N-600K application for citizenship based on parentage. Another important documents to provide is the child’s birth certificate. If it is in another language, the US Citizenship and Immigration Services requires that the birth certificate be translated. If the child is adopted, then the parent can provide a copy of the formal adoption paper. The birth certificate or adoption paper will be beneficial in providing evidence for the relationship between the child and the parent who is an American citizen. The parent will also have to provide the child’s passport or green card. The parent will also have to provide his or her own passport, along with N-600K, to be used as identification. Other information that can be submitted in support of the application include the parents’ marriage certificate, school records, affidavits, and proof of residence.
