The purpose of this application is to allows aliens to apply for permanent resident status as an immigrant, or to change status from that of a non-immigrant that of an immigrant with permanent resident status.  There are many different circumstances under which an alien will file a Form I-485 and there are different addresses for filing your paperwork depending on your circumstance (i.e., a person applying under a K-3 visa will send paperwork to a different address than someone who is diversity lottery winner or an asylee).  Please check the USCIS website for the current address online at the USCIS website at www.uscis.gov; or by phone at 1-800-375-5283.

If you have broken any of the restrictions of your visa, you may not be eligible to file for permanent residence status.  Your visa must not be expired; you must not have worked if not authorized to work, etc. 

Important Facts About The I-485 Process

  • Filing fees vary for Form I-485: the usual fee is $930 plus a biometric fee of $80 but there is no fee for refugees and no biometric fee for applicants over 80 years of age. Children under 14 years of age have a fee of $600 if applying with at least one parent.
  • If you file Form I-485 after July 30, 2007 there is no additional fee for your application for employment authorization (form I-765)
  • You can file Form I-485 if you have been granted asylum or admitted as a refugee and you have been physically present in the U.S. for at least one year
