An H1B Visa is, in essence, a work visa.  It typically allows highly skilled, non-U.S. citizens the opportunity to live and work in the United States.  The H1B Visa enables its recipients the ability to apply for a green card – this makes it a dual intent visa.  In order to be granted this type of visa, an applicant must find a H1B sponsoring employer.  Without the sponsor, the H1B visa cannot be granted.  You should ask the following questions of potential employers when seeking an H1B visa.

  1. Are there any fees for processing the H1B Visa? - Contrary to popular belief, all H1B visa sponsors may not cover the fees for processing the H1B visa.  You should definitely ask your future employer if they do so.  In the event that the H1B sponsor does not cover these fees for you then you will need to know exactly what your financial and job-specific commitment will be to the company.
  2. Do you cover dependents visa? - You will definitely need to know if your potential sponsor (employer) will cover the processing costs for your dependents should they want to come to live with you in the United States.  Additionally, you should ask when your dependents can come to the United States.
  3. Do you cover travel expenses? -  This is a very important question to ask.  Do not avoid it because you need to know if your airfare will be covered when you and your family make the move to the United States.  It may be a good idea to do a bit of research on airfare rates, so that you have a point of negotiation.
  4. What will my salary be? - This is a crucial question that you should definitely ask of your sponsor.  You will need to know how much you’ll be making as well as the method of dispersal (check or direct deposit) as well as the frequency of dispersal.  In order to effectively plan your lifestyle (and that of your family) you will need to have this information handy.
  5. What benefits (if any) can I expect to receive? - It is a standard practice for many American companies to provide medical, vision and dental insurance benefits to their employees.  You will want to ask if you are eligible to receive the same benefits as your American colleagues or will you be forced to pay out of pocket for these benefits.
