NACARA 203 Relief for a Qualified Family Member
In order to apply for NACARA 203 relief for a qualified family member, there are a number of requirements that need to be met.
NACARA 203 Relief for a Qualified Family Member
The requirements for filing NACARA 203 relief are as follows:
- First, a qualified family member is consider to be either a Guatemalan national who first came to the United States prior to October 1, 1990 and registered for ABC benefits prior to December 31, 1991.
- A qualified family member could also be a Salvadoran national who first came to the United States prior to September 19, 1990 and registered for ABC benefits no later than December 31, 1991. In both cases the Guatemalan and Salvadoran national could not have been apprehended at their time of entry in to the United States after December 19, 1990.
- Additionally, a qualified family member can be either a Guatemalan or Salvadoran who came to the United States prior to December 31, 1990 and applied for political asylum prior to December 31, 1991.
- Furthermore, at the time of filing the above-mentioned individuals would have needed to be nationals of one of the following countries: the Soviet Union, Russia, Republic of the former USSR, Germany and the former Yugoslavia.
In order to be considered a qualified family member eligible for NACARA 203 Relief, the person would undoubtedly need to be a Guatemalan or Salvadoran as well as being the spouse, child or unmarried adult child of a Guatemalan or Salvadoran national who meets the above-mentioned criteria. The Guatemalan or Salvadoran national would have had to have been granted what is deemed a suspension of deportation or a complete cancellation of removal from the United States.
Additionally, if there is an individual whose immigration status is classified as an alien, this individual would need to show proof of being issued an Order to Show Cause. If they were in the midst of deportation proceedings prior to April 1, 1997 they would be eligible for the NACARA 203 Relief as a qualified family member. Yet another qualifier occurs if the individual was battered by a Guatemalan or Salvadoran national who met the above-mentioned requirements, then he or she would be eligible to receive NACARA 203 benefits.
