The interview for marriage between an American and a foreign citizen is important for the marriage to occur and will involve a marriage visa. The purpose is to ascertain that the marriage is real, and not just a ploy for getting the benefits for immigration purposes. The parties involved need to convince the interviewer that the marriage is real. By no means should any one lie, for doing so may result in a charge of perjury.

The Traditional Marriage

Responsible for the interview is the United States Citizenship and Immigration Services (USCIS). They will be working to find any evidence that the marriage is a traditional one, before a marriage citizenship can be issued. Documentation needs to be provided as to the relationship, such as photos, bills, joint bank accounts, and so on. A lawyer that is hired for the task will help in preparing everything needed to pass the interview. It is very important to prove that the couple lives together and are truly going to be married due to love.

The interview will consist of a good number of very personal, and perhaps private questions. The answers will need to be as detailed as possible, but more so the demeanor and body language of the person under interview are also looked at. Sometimes, couples will be split up and interviewed, seeing if the answers will match between the two. One may be asked about the other, specific and seemingly trivial details, about the wedding, spouse, favorite colors, etc. It is important to not lie to guess. If you do not know or recall, say so. It is a trying time and the interviewers understand that. Many times, the best way to prepare is to undergo mock interviews, in order to get comfortable.

What May Go Wrong

One important factor is that if anything with the marriage may be viewed as non traditional, for personal, medical or any other possible reasons, a lawyer should be consulted as they will know how to convey this to the USCIS without harming your case. An example is if the two live in different cities due to job or schooling. This will make the interview harder in that it is more difficult to prove the marriage real. Other issues, such as language, cultural differences, or education can also impose upon the interview. These are covered by the attorney, who will work to prepare couples for the interview and give them the best chance.

Any older marriages must of course be dissolved properly. This includes in other countries. If either party was involved with a prior case of a fraudulent marriage, then it will be severely more difficult to prove a real one. Prior arrests can have a sway, and should be discussed with the lawyer and have the lawyer present. The USCIS will have access to full records of the couple, and it is important to be prepared.
