Some grounds for denial of a green card can be waived if you can prove you do not pose a threat to the welfare of the people of the United States, or to foreign policy.
Certain Health Issues Can Lead to Denial
In an effort to protect the health of the people of the United States, certain health problems will lead to a denial of a green card. The following are some examples:
- A person with certain communicable diseases (i.e. tuberculosis, HIV)
- A person with physical or mental illness which threatens the health and welfare of others
- A person who has not had required vaccinations
Drugs Can Lead to Denial of Your Green Card Application
Drug traffickers, drug addicts and drug abusers will be denied a green card. It is wise to always be honest about issues such as drug use even though it may have a negative impact on your application. Lying on your immigration documents can lead to removal. A finding of drug abuse or drug addiction can be waived if you can prove that you have been rehabilitated or have participated in a rehabilitation program.
Economic Grounds for Denial of a Green Card
The United States government has a very difficult time providing help to all the people living in poverty in the United States. In order to limit more people coming to the U.S. who will need economic support from the government, immigrants who are likely to become public charges will be denied green cards. A family sponsor may file an affidavit of support stating the family will be financially responsible for the applicant and the application may be approved.
Employment Grounds for Denial of a Green Card
Anyone who wishes to come to the United States for employment, but does not have a labor certification, will be denied a green card. Additionally, graduates of unaccredited medical programs and uncertified foreign healthcare workers seeking to work in the healthcare profession will not be allowed a green card.
Crimes and Security Grounds for Denial of a Green Card
Certain crimes will lead to automatic denial of a green card. Crimes like murder or other aggravated felonies are reasons for denial. After the attacks on America on September 11, 2001, immigration officials have cracked down on allowing anyone who might pose a security risk. It is up to immigration officials to define that subjective ground for denial.
