Employers desiring to petition for an alien to enter the United States on a temporary basis in order to receive training or perform labor or services as an H-1B, H-1C, H-2A, H-2B, H-3, L-1, O-1, O-2, P-1, P-1S, P-2, P-2S, P-3, P-3S, Q-1 or R-1 must file the I-129 form or the petition for a nonimmigrant worker.
Sometimes, employers must obtain a certificate from the Department of Labor prior to filing the form. The above-mentioned classifications, which are represented by letters corresponding to visas issued by the State Department, are the different categories of foreign workers and temporary visitors that an employer may petition on the I-129 form.
Because the I-129 form is generally utilized for nonimmigrant categories, in the vast majority of cases, workers who enter the United States via this petition must leave the country when their visa term has expired. The I-129 form is also used by employers seeking to request a change of status or an extension of stay for an alien as a TN, E-1, or E-2 nonimmigrant.
