Students can apply for an H1B visa to come to the U.S. to study. The H1B visa to green card path is a fairly easy one compared to other paths for different visa holders. Foreign students who follow this path typically are hired by U.S. firms or businesses near the completion of their studies. The employers petition for the graduates. Some employers will petition for the non-immigrants to become lawful permanent residents through one of the employment-based immigration categories.
Other employers will wait until after the H1B visa is close to expiration and then make the application for lawful permanent resident. There are opponents who would like to change the law with regard to this green card opportunity. Opponents of this practice of going from H1B to green card claim it is simply a way around the temporary condition of the H1B visa and proponents claim the U.S. should keep the talented students who have been educated in the U.S. in the U.S. workforce.
