The Department of Labor (DOL) is responsible for verifying green card sponsoring employers of visa holders who wish to work in the United States. The Employment and Training Administration (ETA) division of the DOL is responsible for approving labor certification requests. The Department of Labor must certify to the USCIS that there are no able, willing, and qualified U.S. workers for the position for which the employer is hiring a foreign worker.
DOL processing has been streamlined for the petitioning employers, by the ETA’s creation of an online PERM. The DOL PERM refers to the electronic program for approving permanent labor certification which would allow workers to work in the United States permanently. PERM is not used by the worker; rather it is used by your employer. PERM makes the process easier for employers because they can store information in the system to use for future applications. It makes accountability easier for the Department of Labor because they can easily cross-check applications for duplications or for false information.
