How do victims of human trafficking apply for protection as a nonimmigrant in the U.S.?

If you meet the eligibility requirements for being a victim of human trafficking, you can file an I-914 form which is an application for T nonimmigrant status. To be eligible, you must meet the following requirements:

  • Must have been a victim of severe trafficking in persons.
  • Must be physically present in the United States due to trafficking.
  • Must assist law enforcement in the investigation or prosecution of human trafficking.
  • Must demonstrate that you would suffer extreme hardship involving severe and unusual harm if you were removed from the United States. 

If you have physical or mental disabilities, you may be able to apply for T nonimmigrant status without meeting the requirement of assisting law enforcement.  There are no I-914 fees because U.S.C.I.S.
