How can I become a U.S. citizen following my military service?

I have served in the U.S. military but I am not a U.S. citizen.  How can I become a U.S. citizen following my service?

The Immigration and Nationality Act (INA) sections 328 and 329 allow for a member of the U.S. military to become a U.S. citizen if he meets other eligibility requirements for citizenship.  In addition to other requirements, a service member must have certification of military or naval service.  In order to do so, you must file Form N-426 certification.  Once approved, the certification meets the requirements for naturalization.  You will need to list your dates and places of active service and you will need a military official to sign the form which affirms your service.  In addition to certification of military service, you will need the following documents:

  • Form N-400 Application for Naturalization;
  • Copy of form DD-212, Certificate of release or discharge from active duty; and
  • Form G-325B. Biographic Information
