Form I-821 use is designated for foreign nationals seeking temporary protected status (TPS). TPS applicants must meet Form I-821 eligibility requirements. The threshold requirement is that you must be a national of a country, or must have habitually resided in a country, designated for Temporary Protected Status. Applicants must file Form I-821 during the open registration period and must meet the requirements of a clear background check, of living continuously in the U.S. since the date specified for the applicant’s country, and must not have been convicted of any felony or persecuting others. Once approved, a TPS nonimmigrant may not be removed from the U.S., or detained, during the time of protected status. They can apply for employment authorization documents as well as travel documents.
