How are countries chosen to participate in Temporary Protected Status programs?

Immigrants looking to file I-821 form, Application for Temporary Protected Status must be nationals of countries designated by USCIS as eligible for status. Countries suffering from the following conditions may be designated as a country for Temporary Protected Status:

  • Ongoing armed conflict (such as civil war)
  • A natural disaster (such as earthquake)
  • Other extraordinary and temporary conditions

A specific time period is assigned to each country for protected status based on the conditions in the country and the amount of time U.S. immigration officials believe it will take for the extraordinary conditions to be resolved.  Extensions may be granted to a country if conditions are not resolved as anticipated. Currently, the countries eligible for Protected Status are:  Honduras, Haiti, El Salvador, Nicaragua, Somalia, and Sudan.
