To be eligible for this type of merican visa, an alien must have an approved petition for classification as a VAWA self-petitioner or have been inspected and paroled or admitted into the United States. In order to qualify for an adjustment of status visa, an alien must 1) apply for the adjustment, 2) be admissible to the United States as a permanent resident and eligible to obtain an immigrant visa, and 3) have an immigration visa immediately available to him or her when the application is filed. It is within the Attorney General’s discretion to approve an adjustment of visa application.
