I 9 Employment Verification Form

The I-9 Employment Eligibility Verification Form is required for all employers in the United States to document the identities and work authorizations of new workers. The form cites specifically which documents employers may accept from new hires in order to verify not only their legal identities but also their rights to work in the United States. As a part a requirement under the jurisdiction of immigration issues, the Form I-9 falls under the administration of the U.S. Citizenship and Immigration Services (USCIS) and enforced through Immigration and Customs Enforcement (ICE). Both USCIS and ICE are agencies within the Department of Homeland Security. While employers are not required to file Form I-9 with USCIS or ICE, they are required to keep it on file, accessible upon request by an authorized government official, and employers are given the option to take part in the free and voluntary program, E-verify, should they choose to double-check the validity of the documents submitted to them by their new hires. The current version of the Form I-9, dated February 2, 2009, is the only version considered valid for compliance purposes.

  • In all U.S. States and Territories, except Puerto Rico, only the English version of the Form I-9 is considered valid. In Puerto Rico, the Spanish translation is acceptable.
  • A major change to the compliance to Form I-9 introduced by the February 2, 2009 revision is the requirement for employers to only accept unexpired documents. Previously, expired documents, such as U.S. Passports, were acceptable.
  • Employers may not dictate to employees which documents the employee chooses to produce to the employer for I-9 verification so long as the employee chooses to provide acceptable documents as listed by the Form.
