H1B Visa

An H1B visa is a non-immigrant type of visa in the United States that allows US employers to seek temporary help from foreign citizens. An H1B visa is granted by the Immigration & Nationality Act and allows for employers to grant employment to a citizen of a foreign nation in a job category that is considered to be a specialty occupation. This type of visa requires proof that that US employer has advertised and actively sought out US workers to fill the position with no luck in finding a match. The employer within the United States sponsors the H1B visa for the individual that they bring in as a part of their organization, and it is only done on a short term basis.

  • The cap of 65,000 H1B visas as established in 2006 does not include or apply to non-profit organizations. .
