H 1B Visa Stamping

According to the United States Citizenship and Immigration Services (USCIS), the H-1B Visa is a nonimmigrant classification used by a foreign national coming to the United States under a temporary employment in a specialty occupation. The term specialty occupation, according to USCIS, requires theoretical and practical application of a body of specialized knowledge along with at least a bachelor's degree or its equivalent. As listed by USCIS, examples of specialty occupations include architecture, engineering, mathematics, physical sciences, social sciences, medicine and health, education, business specialties, accounting, law, theology, and the arts. In order to be eligible for H-1B status the nonimmigrant must be sponsored by a U.S. employer who has filed a labor condition application (LCA) with the Department of Labor. In most conditions, H-1B nonimmigrants are permitted to work under the LCA and reside under the H-1B visa for a maximum of 6 years. USCIS can only issue a limited number of H-1B visas every each, with a current cap of 65,000 per year.
