In the United States, there are a number of avenues through which foreign nationals may apply for lawful permanent residence (LPR). The two main paths to LPR status are through family and through employment. In order to be eligible for immigration through family, the foreign national must be sponsored by a relative who is a U.S. Citizen or a lawful permanent resident. The process begins with submission of Form I-130, Petition for Alien Relative, and Form I-864, Affidavit of Support, with the United States Citizenship and Immigration Services (USCIS). Once the petition is approved, the application enters a queue at the State Department for the issuance of a immigration visa number. Once the number is issued, the immigrant either files a Form I-485, Application to Register Permanent Residence or Adjust Status, if he is already in the United States, or he visits his local U.S. Consulate to complete the process. For the other main avenue to LPR status, the USCIS processes petitions for immigration through employment. In this process, an employer acting as a sponsor for the immigrant, submits a labor certification request, Form ETA 750, to the Employment and Training Administration (ETA) at the Department of Labor. Following approval of the ETA request, the employer initiates the submission of Form I-140, Petition for Alien Worker, with USCIS.
