ETA Form 9089, the Application for Permanent Employment Certification, is processed by the Employment and Training Administration (ETA) at their Atlanta, Georgia Foreign Labor Certification National Processing Center. Employers intending to bring a foreign national to the United States for employment are required to submit ETA Form 9089 prior to submitting the foreign national's, Immigrant Petition for Alien Worker, Form I-140, to the United States Citizenship and Immigration Services (USCIS). The ETA application is used by employers to demonstrate that no qualified U.S. workers are available for the open job position. The employer is further required to document active recruitment for the position in the U.S. and to offer the position at the "prevailing wage" as determined by the appropriate State Workforce Agency (SWA). After approval of ETA Form 9089, the employer must then pursue the visa process for the foreign national with USCIS. In order to minimize processing time, employers are encouraged to submit the ETA Form 9089 electronically through their web-based system rather than submit the form through the mail.
